Terms and Conditions

These terms and conditions were last updated on 20/05/2003. Use of our website and the sale and purchase of goods from the website are governed by our terms and conditions as set out below. “We” or “Our” means Southwest Paintball Ltd, Paintball Warehouse (UK) and / or our Merchants. “You” or “your” means the person accessing, using or ordering from our website over the Internet.

1. Prices, description and availability of goods

Prices are subject to change without notice and all goods are sold subject to availability. Where goods are temporarily out of stock we will contact you so that you may choose between a refund on the item, having it shipped when it is back in stock or selecting an alternative product. Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions. Colours may vary slightly from those shown on the website due to the limitations of Internet technology. Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation.

2. Sales tax

Value Added Tax (VAT) is calculated into all prices listed on our web site. It is included in the price for orders shipped to destinations within the European Union (EU). For orders shipped to destinations outside the EU the price will exclude VAT but orders may be subject to local sales tax or import duty. We will inform customers ordering from outside the EU of the actual price after they have placed their order. Customers are then liable for payment of these taxes or duties on or following delivery.

We operate this way because we are primarily supplying customers within the EU and including VAT is more convenient for these customers.

3. Payment methods

You may order online using a credit / debit card (we accept Visa, MasterCard, Eurocard, Visa Electron, Switch, Solo and JCB Cards). You may order by fax, telephone or post using credit / debit card, cheque or postal order. All prices are in pounds sterling (£) and credit / debit card transactions for orders outside the UK will be converted by the card company at their current exchange rates. Cheques and postal orders should always be in pounds sterling made payable to Southwest Paintball.

3b. Payment methods and commissions

When placing an order with a credit card you will be charged a commission surcharge of 3% - this is added after we receive your order and not shown on your on-line receipt. Debit cards, cheques and postal orders are not subject to surcharges.

4. Delivery arrangements

Your shopping cart displays the goods you have purchased. Goods will normally be despatched within 3 working days to the delivery address which you supply. We will notify you if your goods are not able to be despatched within this timescale, e.g. some ‘made to order’ or 'rare' goods may take longer. Any delivery times quoted are estimates, based on availability and normal delivery time. Additional time should be allowed where payment is made by cheque, as we will not despatch goods until the cheque has cleared. Please note that there are some products that we do not ship to certain destinations, which will inform you of after you have placed your order.

5. Cooling off period and cancellation / returns

We offer a 30 Day Money Back Guarantee on all new and unused items in their original packaging. Use is defined as any attempt to open packaging, fire, install, wear or wash. All manufactures provide at least a 90 day (some offer 1 year) full parts and labor warranty on guns.

Used products may not be returned. All defective products must be repaired / replace / exchanged / refunded by the manufacturer. We will not accept exchanges / returns on defective merchandise, please contact the manufacturer. Shipping costs for returns are the responsibility of the purchaser. Shipping costs will not be refunded on returns or refused packages. Southwest Paintball will not be held responsible for typographical errors.

All third party copyright, trademarks, brand names, product names and titles on this website are acknowledged. This website is protected by Copyright and the Copyright, Trademarks, logos and Intellectual Property rights for the content of the Paintball Warehouse (UK) website are the property of Southwest Paintball Ltd. ALL RIGHTS RESERVED. Any use, printing or copying of materials on this website, other than in the course of browsing, selecting products and ordering from us, is strictly prohibited. Any framing of this website is prohibited.

9. Security

Security is one of our highest priorities and we take every precaution to protect your personal information both online and offline. Information requested when registering or ordering goods (including your credit / debit card details) is encrypted with SSL (Secure Socket Layer), the industry standard encryption software. While we use SSL encryption to protect sensitive information online, we also protect your personal details off-line. All employees are kept up-to-date on our security and privacy practices and they maintain our standards of security. We are committed to protecting your privacy. We use the information we collect about you to process orders and to provide a more personalised shopping experience. We will not sell, share, or rent this information to others other than as disclosed in this statement. During the registration or ordering process we collect some or all of the following information:

We will confirm your personal details on our acknowledgement of order. If you have registered you may check, amend or remove your personal details by clicking the "My Details" button. By registering or ordering through our website you consent to the collection and processing of your personal details by us.

10.2. Registration and Newsletter

Registration is required to use our website, but may be done at the point of order. To speed up future purchases and avoid retyping your details you register with us and we will store your personal details securely with access protected by a user name and password. We send all new members a welcoming e-mail to verify Username and Password. When registering you may opt to receive regular newsletters, marketing information, special offers and website updates from us. If you wish to receive these without ordering please register anyway. If you no longer wish to receive our newsletter or promotional materials you may opt-out of receiving these communications by e-mailing us at unsubscribe@paintballwarehouse.co.uk or changing your registration details by clicking on the 'My Details' button.

10.3. Cookies

A cookie is a piece of data stored on the user's hard drive containing information about the user. We may use cookies to track the patterns of behaviour of visitors to our website. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

10.4. Log Files

We use IP addresses to analyse trends, administer the website, track user's movement, and gather broad demographic information. IP addresses are not linked to personally identifiable information.

10.5. Sharing

We will share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.

We are not responsible for and accept no liability for the content or privacy practices of any linked website which is not owned and maintained by us. We encourage our users to be aware when they leave our website and to read the privacy statements of each and every website that collects personally identifiable information.

10.7. Surveys & Contests

From time-to-time our website requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and address), and demographic information (such as postcode, age level). Contact information will be used to notify the winners and award prizes and may be used to send you marketing or promotional materials where indicated. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this website.

If we change our Terms and conditions, Privacy policy or Security policy, we will post notification of these changes on our Homepage so you are aware of them. Should we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we would notify you by e-mail and request your agreement to the changes. We will use information in accordance with the privacy policy under which the information was collected.

12. Legals

The contract will be governed by the laws of England and Wales and you agree to submit to the jurisdiction of the English courts.
These terms and conditions do not affect your statutory rights as a consumer.
